(male announcer) this is the bay area news station, kron 4 news starts now. >> catherine: now at five. a crackdown on commuters trying to cheat the toll system on the bay bridge. cars and trucks, pulling over to the side of the freeway -- waiting until the clock ticks up, and the toll price goes down. now, the highway patrol is putting a stop to it. i'm catherine heenan. kron4's justine waldman is live at the bay bridge toll plaza. justine -- this seems like a dangerous manuever - just to pay a slightly cheaper price? >> reporter: sure you can save 2-dollars by waiting it out. but is it worth the 100 to 200 dollar ticket that comes with it if you get caught? something to think about as the chp is agressivly looking for these toll evaders. we caught some offenders on camera this morning. some drivers pulled over to the shoulder. some in the median. and others just drove so

slow! the chp was there this morning to give them all tickets or warnings. at 10am the toll price drops from 6 to 4 dollars. so the drivers.as you see. do what they can time it just right. chp told me this creates a lot of problems. for one it is a huge traffic distraction. plus, chp officers respond to too many calls of "cars on the side of the road" for no reason so it is a waste of resources. and accidents can happen when the driver pulls back into trafficat a very congested area. if you get caught the ticket is for a non- emergency stop. so weigh that with the extra 10-dollars a week in savings for waiting it out might not be worth it. bell, the c h p is out here looking for you. live at the

bay bridge toll plaza justine waldman kron 4 >> catherine: police presence is way up. and attendance is way down at foothill high school in pleasanton. the problem -- this threat found spray-painted on the wall of a school bathroom. it says " watch me shoot everyone on march 14th" --- which is today. we're just getting the final numbers on how many students stayed home the school district says 675 of them didn't show up today. 509 left school early. and that's out of a total of 22-hundred enrolled. kron 4's maureen kelly shows us what it was like for students who came to school despite the ominous warning. >> it was weird because no one was there >> reporter: here's a photo that shows empty seats inside one classroomseveral students told me that in some of their classes. more than half of the usual number of students didn't show up were more than half empty.one kid says he only showed up to school because of a chemistry testand it turned out he could have just stayed home too his mom ended up taking him home early

>> i did not want to be in an unsafe environment. the distict says about 80 kids were out because they are involved in sports teams that are away in compeition. >> that is their prerogative to do with the need to do to sleep at night. >> reporter: but they do acknowledges that some parents told them they were keeping their kidsseveral kids said there were reassured by the increase in security.including the heavy police presence that could be seen all day around campus.but some were still a little jittery. >> i feel a little risky, and the school but it is fine. >> reporter: others say today was just a mellower day than normalbecause there were fewer people there saying they didn't take the threat serisouly in the first place. maureen kelly kron4 news. >> catherine: new tonight.a 14-year-old boy has been arrested in connection to two bomb threats at fremont's thornton junior high school. police say the student was arrested on campus today for bomb threats made at the school yesterday and today administrators in san jose's east side union high

school district are trying to explain how a registered sex offender managed to ride a school bus with high school students. kron 4's dan kerman is here with the story. and what's being done about it. >> reporter: it began with a group of high school students going on a school sponsored field trip to de anza college. these were freshmen. anyway, after the tour the students boarded the bus to head back, but at the time, a staff member spotted a volunteer parent who had no ride. this parent is wheelchair bound and was with another person who was helping her. the staff member let both aboard the bus. well now it turns out that the person helping the wheel chair bound parent is a registered sex offender. school administrators say the staff member violated policy by letting the two on board. that said, school officials say the sex offender had no contact with students >> at no time, based on the preliminary investigation did this person have any interaction with students.

there were only of the school bus to return back to the school. they sat at the front of the bus and the staff member said next to them. it was a natural buffer even though it was not intentional. >> reporter: this happened last month. this week, parents were informed, school policy is being reviewed, and the school staff member that violated policy by allow the two to board the bus is being dealt with. in the meantime, san jose police is looking into the matter. >> catherine: thank you, dan san jose police have arrested this man -- saying he had child pornography. he is nathan forstell-- a 44 year old grade school substitute teacher.. police served a search warrant at his east san jose home and found the material.. forstell had been a substitute teacher for several schools in the alum rock school district in san jose between 2008 and 2011. >> jacqueline: certainly cooler this afternoon as we anticipated. low 70's with

the north bay in the inland valleys. things are cooling off back into the 60s. let us take a look outside with that cloud coverage. this storm passing to the north we are just getting the cloud coverage. with the rained to the north we can see that it is impacting us for the next several hours. still, cloud coverage tomorrow but not as bad as it today. here is of a fog near the coast the clouds will still stay in place with the sea breeze. that cooling trend will continue for this weekend. rainfall, wind is going to come back, next. with the rainfall. >> catherine: new tonight -- the latest skirmish in the on-going battle over public beach access in california is underway in half moon bay. martin's beach is 10 minutes south of town - and is a favorite of surfers

and fishermen. it's now off-limits - with a locked gate. but as kron four's rob fladeboe reports - surfers and their supporters risked arrest today as they defied a developer's attempts to keep them away. >> reporter: carrying signs and surfboards, a handful of activists climbed over a locked gate and headed for the beach. the half-mile road to martin's beach used to be open to all, but now a developer is trying to keep it closed. longtime bay area lawmaker and surfrider foundation attorney pete mccloskey says that's not right. >> the issue is that the people of california has a right. this date is not right. >> reporter: five surfers were cited for trespassing last year but sheriff's deputies kept their distance this time. the surfers have filed a lawsuit, alleging that property owner martin's beach l.l.c, led by wealthy silicon valley venture capitalist vernod kholsa, violated the california coastal act by failing to get a permit for that gate and other restrictive measures.

>> the entire idea is to of the property owner is required to go to the california coastal commission and to get approval to prevent beach access. >> reporter: prior to it's sale in 2005, martins beach, as these hand-painted murals show, was a popular place, open to everybody. surfer joao demaceeo hit the waves at the well known break and later added his voice to the debate. >> id is not just an example for california but fights all over in the world. >> reporter: plans reportedly call for multi- million dollar beach-front homes when leases to the current residents expire. an attorney for the developer did not respond to a request for comment. in half moon bay rob flaeboe kron 4 news. >> catherine: martin's beach sits along a mostly rural stretch of the pacific coast. kron 4's charles clifford gives us an aeriel view of the area. >> reporter: martin's beach is about 6 miles south of downtown half moon bay. the beach is a curved stretch of sand with several steep cliffs nearby.

there are several homes and rental cabins along the beach, but all of these buildings are the property of a single owner. there's also just one road, martin's beach road, connecting the beach to nearby highway one... this is the road that has been blocked off by the owners to prevent the public from accessing the area a lock gate has been installed across the road. here in the newsroom, charles new gun control legislation. >> catherine: still awaiting more bay area news. a milpitas police officer escaped injury.when his unmarked car was hit from behind by an s-u-v. it happened about four this morning, on jacklin road

dancing that was a bit much. thank youthanks gabe -- right now, let's go to grant lodes, with more on apple's reaction. >> this new android phone being unveiled by samsung today appears to have ratteled top execs at apple. last night, in an unpresedented move by apple's head of marketing.phill schiller.went to the press.the wall street journal.reuters and bloomberg.and schiller blasted the competition.google's android operating system which runs on samsung phones. schiller said android phones are popular because droid's are often given as a free replacement for a feature phone.and that the experience is not as good as using an i-phone. he also said android is a "fragmented" platform.meaning different companies are involved.samsung, google, etc.where as apple manufactures its own phones and i-o-s operaing system. schiller added that apple research indicates that four times the number of people switch from android to apple compated to people that switch from apple to android. >> jacqueline: it was

noticeably cooler and we will continue that cooling trend. not quite as drastic as tomorrow. barely overcast with cloud coverage. as we go for the saturday, sunday we are still going to have a little cloud coverage. temperatures are pretty mild. still, cooler than what we have seen it. the satellite is showing the cloud coverage over the north bay and along the coast. towards the bayshore. this satellite and radar with this system to the north. it is portions of the system that will continue to bring us cooler temperatures and cloud coverage as a result. once this moves through more clouds and sunny conditions for tomorrow. as for the fog i think that we are going to see more for tomorrow. dense

as what we saw this morning. the fog is confined mainly to the coast. this is not showing that much but i think that we could see more fog for a san francisco, oakland richmond and the bayshore. the reason why the computer model is showing this limited fog is the wind from the north is expected to be strong. the sea breezes are strong. i think that we could see clearing by 11:00 a.m. but still some high clouds to deal with. slightly cooler conditions. temperatures in the '70s. city and a mixture of '60s and '70s for the north bay. waking up to some fog the same on a saturday. and as we go for next week we will see changes on tuesday and wednesday. there rainfall could return wednesday morning. the chance of lingering showers on thursday. another cruise vacation gone wrong. carnival is scrambling to charter flights for thousands of passengers after their ship became inoperable at a caribbean port. karin caifa reports. >> reporter: it's been just a month since a fire aboard the cruise ship "triumph" stranded passengers for days, now carnival may have another p-r nightmare on its hands. the "carnival dream" experienced generator problems while docked at st. maarten in the eastern caribbean. passengers say the power was turned off as crews tried to fix it. >> "it was down for probably about three hours, during that time the toilets

started overflowing down in the main general lobby areas where people where frequenting in the bathroom." >> reporter: carnival says a malfunction occurred during regular testing of the ship's emergency diesel generator, and only one public restroom was taken offline >> "when they restarted the system, they noticed there were errors. thought it was an easy fix. as it progressed into the night, they realized it was a bit more complicated and a few minutes ago they determined that it was not something they can get fixed." >> reporter: kris anderson, a vacationing news anchor from memphis, says friends gave him a hard time for taking a carnival cruise so soon after the triumph disaster. but he says this does not compare to the triumph debacle. >> "i do want to say, the toilets are working, the power is on. we have full air conditioning." >> reporter: carnival says it's making arrangements to fly passengers home, and will offer refunds and future discounts. tuesday the company announced a comprehensive review of all 23 of its ships. this latest setback makes that review all the more urgent.

more on the bill, its chances and what made dianne feinstein so angry. >> she was hot today. the bill cleared the senate committee, which has a democratic majority. republicans control the full senate, and senator feinstein admits she is facing an uphill battle there. but what got her blood boiling is when texas senator ted cruz, a tea party republican, began what she called a lecture on the constitution. >> one, i'm not a sixth grader. senator, i've been on this committee for twenty years. i was a mayor for nine years, i walked in, i saw people shot. i've looked at bodies that have been shot by these weapons. >> nearly 25 years ago, when feinstein was a san francisco supervisor, she was witness to a double murder just a few steps from her office at city hall. >> both mayor moscone and supervisor harvey milk have been shot and killed. >> reporter: she says the horror of that day has never left her. >> i can not get out of my mind trying to find a pulse in someone and putting fingers in a bullet hole. i can not get out of my mind walking into a crime and seeing the brain matter all over the carnage.

>> reporter: in 1994, she sponsored a federal ban on assault weapons, which expired ten years later. after the newtown school massacre, she re=introduced the ban.when the texas senator accused her of seeking to subvert the bill of rights, she let him have it, with both barrels. >> you know, it's fine you want to lecture me on the constitution. i appreciate it. just know i've been here a long time, i've passed on a number of bills. i've studied the constitution myself, i'm reasonably well educated and incidentally, this does not prohibit. you used the word prohibit. it exempts 2,271 weapons. isn't that enough for the people of the united states? do they need a bazooka? >> reporter: feinstein's bill it would bar the sale or manufacture of military- style assault weapons like the ar=15, used by the killers in aurora and newtown last year. it would also ban high=capacity magazines, used in the shooting that wounded gabby giffords. according to one report, assault weapons have been

used in 20 mass murders in the past 30 years. high capacity magazines in 42. but for gun control advocates, the important number is 60. that's how many votes they need to break an expected gop filibuster. >> "it's pretty clear that the assault weapons ban has become -- the other party's been locked in against that. so i don't see us getting 60 votes." >> reporter: as for feinstein, she says if her efforts farrell issue will continue to ban high- capacity magazines. she has cooled down. the families of some of the young victims gunned down in the sandy hook elementary school shooting were in san francisco today. they joined bay area leaders to mark the three-month anniversay of the massacre. and announce an initiative to prevent future gun violence. >> we can feel the need for change. there have been been

the senseless losses before and a sense sandy hook we are determined to make this change for our country. >> catherine: on december 14-th. 20 students and six adults were killed in the shooting in newtown, connecticut. their initiative. called the sandy hook promise innovation initiative. will use money from venture capitalists. to invest in new innovations in gun safety. mental health research. and school safety. san francisco mayor ed lee today said he is determined to reduce gun violence. today he announced he signed into law two ordinances-- banning possession of hollow-point ammunition in the city. and requiring businesses to notify police if large amounts of ammunition are sold in one purchase. >> the head of the t-s-a.now defending his decision to allow passengers to bring small folding knives.and things like golf clubs onto planes. as more and more groups and people pile on and criticize the decision.the t-s-a is holding firm.saying if finds and confiscates about

2-thousand small pocket knives evey day.when its focus should be on explosives. >> it takes to-three minutes to be identified and for the back to be opened. and for the knife to be found. and ran it through back through the scanner again. >> reporter: the t-s-a head told a house panel today that's hardened cockpit doors and other preventative measures make it unlikely terrorists could use small knives to takeover a plane. >> catherine: in additions to knives -- you might be surprised to learn what passengers try to take on planes. >> every year, about 750- thousand items are surrendered at airport checkpoints. illegal items like guns, grenades and brass knuckles are handed over to local law enforcement. prohibited items including knives, large tools and sporting equipment are sent to the nearest state willing to accept them.

making tough choices about how we solve our nation's problems." >> catherine: republicans and democrats released their federal budgets this week. the republicans' plan now would cut spending by nearly five-trillion dollars over a decade without raising taxes. the democrats' plan is aimed at reducing the deficit by about a trillion dollars over ten years by using spending cuts and tax increases. the president will release his own proposal next month. >> catherine: this was the first full day on the job for pope francis. catholics hope it marks the beginning of a turnaround after years of scandal. erin mclaughlin has the latest from rome. >> reporter: as part of his new day on the job he celebrated mass with the cardinals who voted for him.

>> he is taking the helm at a pivotal time that has been rocked by a pivotal difficult times. but they're hoping that this is the changing tide. >> we have a pulpit and pope and the shepherd. >> catherine: the new pope is living up to his reputation of keeping things simple. he did not sit on the traditional throne to accept oaths of allegiance from the cardinals. he refused to ride in a private car back to his residence last night.choosing instead to ride in a shuttle bus with the cardinals who elected him. he'll be formally installed on tuesday. >> catherine: california treasurer bill lockyer is no longerivorce from his wife. lockyer withdrew the divorce papers this week-- which were filed back in july against his wife, nadia. former county supervisor nadia lockyer was arrested back in august after authorities say she was showing signs of methamphetamine

intoxication. lockyer says he is proud of the progress his wife has made in a drug treatment program, and the two have agreed to try to reconcile. >> jacqueline: temperatures cooler today. right now things are even cooler that cloud coverage has been a rolling in with the 60s in santa rosa. for the inland valleys still 70's. portions of that area and the south bay. this is why as we take a live look at oakland hills. the cloud coverage moving in add fog near the coast mainly it is this high cloud coverage that we have been dealing with. overnight in some areas near the coast that will be cooler tonight and last night. that will be the trend for the next several days. and cooler for this week as the rain pushes and.

now for today's market update. >> catherine: the dow extended its winning streak for the 10th straight day. the longest winning streak since 1996. here are the closing numbers. the dow rose 83 points to close at 14-thousand-539. the nasdaq rose 13 points. and the s-and-p came within two points of its all-time high.after gaining 8 points. >> reporter: cooler weather. >> jacqueline: 70's in a number of places. and to snap-on with the in the valleys mid-70s and upper 70's. through -- snap-on. this stark contrast where we have seen the sea breeze

dominate. as we look for tomorrow we are going to wake up to some fog and high cloud coverage. outside of the golden gate bridge is exactly what we are seeing. some of that cloud coverage. as we go towards the weekend mild conditions will persist. cooler. temperatures will be more in the '60s and '70s. the satellite and radar. it is an impact of the bay area that the system to the north of us is associated. no rain is expected to we are going to see some cooler temperatures tonight. let us take a look at the fog tracker. i do not entirely agree with the computer monitor with minimal fog along the bayshore at 6:00

pacifica. this stretch of road is known as devil's slide. the highway here has been plagued for decades by falling rocks and unstable ground, but on of march 26th this mile and half long stretch of roadway will be permanently closed to traffic. and cars traveling on highway one will be re- routed through a pair of twin tunnels that bypass devils slide altogether. to the north, highway one will closed down here and traffic will be transferred onto a pair of new bridges that lead to and from the tunnels.. which enter the mountain here... each tunell will have a single 12 foot wide travel lane with shoulders on each side. once cars enter the tunnels they will travel about 4/5ths of mile underneath this mountain before reconnecting with highway one on the other side, completely bypassing the old roadway. the bypass tunnels have been 8 years in the making with a price tag of 439 millions dollars. a grand opening celebration is scheduled for march 25th.
